Dominguez back in court as retrial proceedings continue

A hearing is on the docket for an Emporia man facing a retrial on murder charges.

 

Jimmy Dominguez will be at the Lyon County Courthouse for a status conference.

 

Dominguez faces retrial in the 2009 death of Jose Leyva after the Kansas Supreme Court said there were faulty jury instructions as part of Dominguez's second trial in 2011. That ruling essentially wiped out both Dominguez's conviction and his sentence. His first trial proceedings in 2010 ended in mistrial.

 

The hearing will be at 1:15 pm. Trial and related hearings have been delayed several times since the retrial was announced, with a number of the delays related to a diagnosis of cancer. Dominguez is currently receiving palliative care for the disease.
