Dominguez murder retrial hearings continue

An Emporia man accused of murdering another Emporian has been set for a hearing early next year as retrial proceedings continue.

 

Jimmy Dominguez, 39, has a competency hearing Jan. 11 following a status conference Friday in Lyon County District Court.

 

Dominguez is gearing for a potential retrial after he allegedly murdered Jose Leyva and wounded Juan Rosales, Jr., in 2009. His first trial proceedings in 2010 ended in mistrial and he was convicted of murder, aggravated battery and discharge of a weapon the following year. However, two years ago the Kansas Supreme Court said there were faulty jury instructions as part of Dominguez's second trial. That ruling essentially wiped out both Dominguez's conviction and his sentence.
