Dominguez retrial delayed again

There has been yet another delay in the Jimmy Dominguez trial proceedings.


Trial was supposed to start Monday but has now been pushed to start on Halloween, according to Lyon County Attorney Marc Goodman.


Dominguez faces retrial in the 2009 death of Jose Leyva after the Kansas Supreme Court said there were faulty jury instructions as part of Dominguez's second trial in 2011. That ruling essentially wiped out both Dominguez's conviction and his sentence. His first trial proceedings in 2010 ended in mistrial.


Trial has been delayed several times since the retrial was announced, with a number of the delays related to a diagnosis of cancer. Dominguez is currently receiving palliative care for the disease.
