Dominguez set for retrial after competency hearing

Jimmy Dominguez has been found competent to stand trial -- or, in his case, retrial.

 

After several delays, Dominguez had a competency hearing Thursday in Lyon County District Court. Another hearing is coming May 5, and a decision on Dominguez's motion for a new attorney was continued as well.

 

Dominguez was charged with murder after allegedly murdering Jose Leyva in 2009. His first trial took place in 2010 and ended in a mistrial. A second trial the following year ended with convictions on murder and other counts, but the Kansas Supreme Court said there were faulty jury instructions. The third trial as ordered by the Supreme Court is set to begin May 15.
