Hearing delayed for Dylan Barber in Mackenzie Payne murder case Featured

A motions hearing is coming next month for a Herington man accused of killing a former Emporian last summer.


A hearing for Dylan Barber in Sedgwick County District Court was originally planned for Thursday but that was postponed to Feb. 4. The hearing will now focus on a motion to endorse witnesses as well as a separate motion for admission of hearsay evidence -- and it will also discuss whether a so-called Jackson-Denno hearing will be allowed in the case. These types of hearings deal with whether a defendant's confession offered voluntarily.

Barber has been charged with first-degree murder and criminal possession of a weapon by a felon after Mackenzie Payne was stabbed to death in late June. Payne was a 2013 graduate of Emporia High and was planning to enter medical school at the University of Kansas when she was murdered.

A jury trial in the case is set to begin March 25.
