Formal charges have now been filed against the grandmother of a 2-year-old Emporia child that was missing for several days, and a tentative first court appearance date is now on the docket.


Lyon County Attorney Marc Goodman says Jessica Suzanne Downs, 41, has been charged with aggravated interference with parental custody. The current plan is to have a first appearance Monday in Lyon County District Court.

Downs is accused of taking Kyrese Cabrera-Downs to his biological father, 23-year-old Devin Downs, before the child was returned to his biological mother Wednesday. Court documents provided to KVOE News say the biological mother had allowed Downs to visit the child Jan. 16. The child was supposed to have been returned Monday morning. This followed a reported discussion where Downs had asked to have the child for a full week and was denied. The mother also told police Downs had threatened to take the child in the past.

Authorities went first to Devin Downs' mobile home in Augusta on Monday after tips Jessica Downs was traveling there to hand the child off, but the child was not present. They then followed tips to Topeka, but that search was unsuccessful. A tip then led Emporia Police to an address in southwest Emporia, where Jessica Downs was arrested.

Shortly after her arrest, Jessica Downs told officers she hadn't communicated regularly with the biological mother, Devin Downs and others because she didn't have WiFi access on her cell phone in most circumstances and she had ignored the biological mother's social media messages after the mother had gotten belligerent. Jessica Downs also said Devin Downs didn't want anybody to know he had custody of the child earlier in the week and that he planned to keep the child away from his biological mother. Devin Downs denied both accusations in a separate interview with Emporia Police.

Devin Downs was arrested on an outstanding Lyon County warrant for allegedly failing to abide.

According to police, Jessica Downs said she delivered the child Tuesday, although the 2-year-old was actually last seen Sunday and Emporia Police requested the public's help late Monday.

Additional details about the chain of events leading to the toddler's discovery are pending.
