The Emporia man accused of murder in the death of another Emporia man following a fatality accident last Thursday had his first appearance in Lyon County District Court Monday.
23-year-old Devawn Mitchell appeared virtually in front of Judge Doug Jones Monday afternoon. Mitchell faces five total counts in the case including first-degree murder and an alternate count of second-degree murder related to the death of Emporia State Athletics Hall of Honor inductee Steven Henry last Thursday.
Additional charges include assault on a law enforcement officer and three counts of felony flee and elude.
Mitchell allegedly led two short law enforcement pursuits at high speeds in Emporia on Thursday. Mitchell allegedly tried to ram a police vehicle to trigger the first chase.
He also allegedly continued at high speeds after the second chase was discontinued when he crashed into a pickup driven by Henry, killing the 64-year-old.
Mitchell is scheduled to next appear inside Lyon County District Court on Monday, Apr. 19 at 2 pm for a preliminary hearing.
