An Emporia man had arrangements for a competency evaluation altered after a hearing in Lyon County District Court on Wednesday.
Raul Magallanez, 44, was originally charged with marijuana distribution and paraphernalia possession after an incident in October 2018. Magallanez was charged after he was allegedly found with marijuana in his car as part of an ongoing Emporia Police investigation against another Emporia man.
In April, Judge Jeff Larson ruled Magallanez was not competent to stand trial and ordered an evaluation at the Larned Correctional Mental Health Facility. When the evaluation was scheduled, Magallanez was almost 40th on a waiting list. He’s now 26th at Larned, so Larson approved defense attorney Rand Simmons’ request to have the evaluation done by CrossWinds Counseling and Wellness instead.
