As ugly as it sounds discussions on ways to remove President Trump from office are not uncommon.
Besides the obvious ones like death or resignation there are two other possibilities: Impeachment or the powers in the 25th Amendment ratified in 1967.
Article II, Section 4 of the U. S. Constitution says The President and Vice President, and all civil Officers of the United States shall be removed from Office on Impeachment for, and conviction of, Treason, Bribery or other High Crimes and Misdemeanors." The House of Representatives has the sole power of impeaching, while the Senate has the sole power to try all impeachments. The removal of impeached officials is automatic upon conviction in the Senate. The federal judiciary cannot review such proceedings. End of story.
Far less known would be using the 25th Amendment. It says:
Whenever the Vice President and a majority of either the principal officers of the executive departments transmit to the President of the Senate and the Speaker of the House of Representatives their written declaration that the President is unable to discharge the powers and duties of his office, the Vice President shall immediately assume the powers and duties of the office as Acting President. And then the fun begins!
This means the Vice President and a majority of the President’s Cabinet would agree that he is unable to perform his duties. It would take 10 of the 18 people on President Trump’s Cabinet to make this move. If accomplished Vice President Pence would immediately become Acting President.
But, the ousted president has the opportunity to respond. It is unclear as to the method he would need to use, but it’s suggested that even writing a note saying “I can still be president” would suffice and Mr. Trump would once again be president!
Next the Cabinet has 4 days to vote again on the question of the President’s ability to perform his duties. If they confirm their earlier vote then the Vice President once again becomes the Acting President!
At this point the Congress is automatically called into a Special Session in which they have up to 21 days to decide to agree or disagree with the Cabinet! There must be a two thirds majority in both Houses to uphold the findings and make the Vice President the President of the United States.
I am not making this up!
If this were to happen we could have 4 Presidents in less than a month.
Once again it is time to pray for President Trump to become a more effective leader.
