Next month’s Kansas Supreme Court docket involves a Lyon County case.
Williams Nunez, listed as William Nunez on the Kansas District Court Public Access Portal and the Kansas Department of Corrections online inmate search, is appealing a ruling in his 2021 Lyon County rape conviction where he was accused of having sex with a person unable to give consent either because of a medical condition or the effects of alcohol or drugs. Nunez admitted sexual relations but said the victim wasn’t too intoxicated to give consent.
A jury found Nunez guilty and sentenced him to 155 months in prison. Nunez appealed his conviction and the resulting sentence. He had sought a new trial from the Kansas Court of Appeals on four grounds: improper jury instructions on the mental state part of his defense, wrongly allowing evidence on the process for the sex assault examination, prosecutor error and the cumulative effect of the errors thus denying him a fair trial. The Court of Appeals found no reversible errors and affirmed both the conviction and the sentence.
Nunez will have a 15-minute hearing before the Kansas Supreme Court on May 6.
