An Emporia juvenile charged with aggravated kidnapping from last fall has seen his case dismissed without prejudice.
According to the Lyon County Attorney’s Office, the decision to dismiss is based upon 17-year-old Daniel Garcia completing his basic training and full term of duty in the U.S. Marine Corps. If Garcia fails to complete both, the state can refile charges against him.
Garcia is one of several individuals charged in the kidnapping and beating of a 16-year-old male Nov. 18. Garcia is said to have driven the vehicle to two alleged sites where the attacks occurred but has never been alleged to have participated in the beatings.
