A panel of Kansas Court of Appeals judges has affirmed the judgment and sentence stemming from a Lyon County theft case.
Alexander Jean Hill had appealed his 12-month jail term for misdemeanor theft arising from a plea agreement last year. Hill was originally charged with one count of burglary of a vehicle, but prosecutors amended that count to misdemeanor theft of property worth less than $1,500 as part of the agreement. Hill appealed his sentence, saying the district court abused its discretion because of his minimal criminal history and this was his first non-drug conviction.
The Court of Appeals, however, said Hill’s sentence was within legal limits and his record check indicated he already was on felony probation when he committed the crime in this case as well as a separate drug-related crime.
