Amerigroup has not said how it plans to proceed after a Shawnee County judge affirmed the state’s decision to end its KanCare contract and go with Aetna in its place.
Judge Franklin Theis rejected Amerigroup’s request for relief after allegations the state used an arbitrary process to choose its KanCare insurance providers. Theis said Amerigroup and AmeriHealth, which also sued, failed to establish “that it has suffered a particularized injury occasioned from the bid terms, the bid design or the basis for the evaluation of the bidders.” He also said the companies were not unreasonably or unfairly affected by the process.
Amerigroup was one of the original KanCare providers when KanCare was first rolled out in 2013. It serves about 125,000 of the roughly 400,000 state residents utilizing KanCare. It can appeal and is “evaluating its options,” according to a spokesperson.
Besides Aetna, Sunflower and United Healthcare are KanCare providers.
