An appeal by the state of Kansas against a state Supreme Court decision regarding identity theft laws will go before the United States Supreme Court.
The federal high court has agreed to review three decisions by the Kansas Supreme Court from 2017. All three, according to Kansas Attorney General Derek Schmidt, involve state decisions that state criminal laws against identity theft or related crimes are preempted by federal immigration law. The Kansas Supreme Court overturned convictions of three individuals, with the majority saying false Social Security numbers used on federal I-9 forms for employment verification fell under federal immigration law, not state identity theft jurisdiction.
Oral arguments are coming this fall. A specific date has not been announced.
