A Missouri man convicted on one count of burglary in Lyon County last year is having his sentence adjusted after both prosecutors and defense agreed there was an error in the case.
Joseph Paul Jones was sentenced to 34 months in prison after pleading no contest to a single count of non-residential burglary. Thirty-nine similar counts were dismissed as part of a plea agreement after Jones had been accused of burglarizing over a dozen local businesses in 2014. As part of the plea, Jones agreed to pay over $12,000 in restitution.
Jones’ defense team said district court made an error when it said restitution for one business went to the business instead of the insurance company, and prosecutors agreed. The Kansas Court of Appeals concurred, so that portion of Jones’ sentence has been sent back to district court for revisions.
Jones’ sentence in Lyon County is running consecutively to sentences for similar activity in Reno County and Greene County, Missouri.
