The robbery cases against Daniel McClead and Gustavo Perez-Garcia are moving forward — just in different ways — after hearings Wednesday in Lyon County District Court.
McClead waived his preliminary hearing and was set for a pretrial hearing Oct. 18. Perez-Garcia, meanwhile, was bound over for trial and had a pretrial slated for Oct. 9.
The pretrial immediately following a preliminary hearing is normally significant because potential trial dates are normally set during the hearing.
Both defendants are accused of robbing the Casey’s convenience store on South Commercial Street twice and Angelina’s Fashion in downtown Emporia once in early June. They both face three sets of aggravated robbery and conspiracy to commit aggravated robbery charges.
