The current case of Kansas v. Magallanez will not be headed to trial.
At a competency hearing Wednesday, Magallanez accepted a plea agreement on a simple drug possession count. He was sentenced to time served.
Magallanez had been in jail since October 2018 after allegedly being caught with marijuana in his car while Emporia Police were conducting a drug investigation involving another Emporia man. He had been charged with marijuana distribution and paraphernalia possession.
The competency hearing was scheduled after Judge Jeff Larson ruled Magallanez was not competent to stand trial in April. Magallanez was originally supposed to have an evaluation at the Larned Mental Health Correctional Facility, but that was moved last month to Emporia.
The court case also essentially implicated Magallanez of violating parole after he pleaded no contest to two counts of aggravated indecent liberties in 2011. Lyon County Attorney Marc Goodman tells KVOE News the Kansas Parole Office will determine whether to revoke parole as a result of the current drug case.
