The Kansas Court of Appeals supports convictions in a Greenwood County drug possession case.
Kim Alan Higbee was arrested initially for driving while suspended and searched, with the deputy finding tramadol and alprazolam. Higbee was then charged with drug and paraphernalia possession along with driving while suspended. During court proceedings, Higbee said he put on somebody else’s pants but jurors still convicted him and he received 28 months in prison.
Higbee’s appeal had several components, including prosecutor violations and errors in sentencing. The Court of Appeals disagreed, saying Higbee did not demonstrate a sentencing error and he did not corroborate any prosecution violations in the case.
