The Olathe man listed as a suspect in a trooper-involved shooting incident a month ago in Chase County is now facing federal charges related to alleged drug trafficking in and around Kansas City. And a decision on state charges for the shooting is now pending in Cottonwood Falls.
The US Attorney’s Office says Dustin Schultz-Bergin, age 40, was charged earlier this month with one count of drug possession with intent to distribute. The affidavit, or law enforcement case narrative, as provided to KVOE News on Friday indicates Schultz-Bergin was identified as “a supplier of illegal drugs” in the Kansas City metro area as part of an investigation dating back to last July.
The affidavit also says troopers were searching for Schultz-Bergin on an active arrest warrant out of Jackson County, Missouri, before finding him at the Kansas Turnpike Matfield Green service exit Jan. 23. A few minutes later and 10 miles up the road towards Emporia, Schultz-Bergin’s car was disabled by stop sticks. He then got out of the car, leading to a confrontation with two troopers and a K-9 unit. Schulz-Bergin, who was allegedly armed with a handgun, was shot at least once and bitten several times. He was taken to Wesley Medical Center in Wichita for treatment, eventually released and immediately taken into federal custody.
According to the affidavit, two women were in the car with Schultz-Bergin during the pursuit and shooting. Neither were hurt. The affidavit summarizes statements from the women indicating Schultz-Bergin was distributing illegal drugs and they were planning to go to El Paso, Texas, to pick up methamphetamine to bring to Kansas City, with cell phone records from one of the women indicating she tried to help him find customers for the drugs.
A subsequent search of Schultz-Bergin’s rental car led to the discovery of over three kilograms of meth, along with heroin, GHB, other pharmaceutical controlled substances, paraphernalia and a gun different from the one Schultz-Bergin allegedly had on him during the shooting.
Schultz-Bergin has a status conference in federal court March 9.
While the federal affidavit references the shooting, there are no formal charges directly linked to that incident. KBI spokesperson Melissa Underwood says investigators turned over their findings about the shooting to the Chase County Attorney’s Office on Friday. A decision on formal charges is pending at this time.
The Kansas Department of Corrections says Schultz-Bergin was convicted in 2018 on identity theft charges in Wyandotte County and in Johnson County on drug possession charges.
