A man convicted in Lyon County District Court of sexual activity with a minor did not get a favorable appellate ruling from the Kansas Court of Appeals.
Joe Louis Stewart, 59, was convicted in 2018 on two counts of aggravated indecent liberties against a girl who was allegedly nine years old during an incident in 2016. Stewart received a Hard 25 sentence with no chance of parole. A count of aggravated sodomy was dropped during trial.
Stewart appealed, saying district court was wrong to both allow evidence of prior sexual misconduct in a separate alleged incident and instruct the jury about the evidence. The Court of Appeals says it found no reversible error and the use of the jury instructions did not deny Stewart of his right to a fair trial.
