The Kansas Court of Appeals has affirmed two rulings in drug cases originating in Lyon County District Court.
Ronald Corbitt has appealed his sentence on possessing methamphetamine after district court revoked his probation, ordering him to serve his underlying 17-month prison term after several probation violations and resulting sanctions. Corbitt also admitted getting kicked out of a substance abuse treatment program for saying he was waiting to get off probation so he could start dealing drugs.
Corbitt said district court abused its discretion by revoking probation. However, the Court of Appeals said district court made no legal or factual error with its decision and said the lower court was reasonable with its decision.
Separately, Randy Wolf had appealed his conviction on meth possession charges, saying prosecutors never proved he “knowingly” had the drug in his possession when he was part of an Emporia Police vehicle stop in August 2018 and had what authorities say was a baggie with meth residue in his wallet.
Prosecutors said the presence of drugs was enough for a jury to reasonably believe the defendant knowingly had the drugs in his possession. The Court of Appeals agreed, saying Wolf admitted the wallet was his and both the wallet and baggie were in his control when the car was stopped.
