If somebody wants to challenge a quarantine or isolation order — or if somebody suspects another person is in violation — the Lyon County Attorney’s Office is poised to handle those cases, although it hasn’t had to take that step yet.
So far, Lyon County Public Health has not issued any formal quarantine or isolation orders, and the County Attorney’s Office does not get involved in quarantine or isolation cases unless an official order is issued by Health Officer Renee Hively and it’s challenged by residents or law enforcement writes an affidavit. Once that happens, residents are entitled to a hearing much like an appellate hearing in other kinds of cases. Hearings will be expedited, taking place within 72 hours of initial filings. Decisions may come during those hearings, or they could come at a second hearing if residents ask for attorneys.
Residents may challenge a quarantine or isolation order, but if they decide on a legal challenge, they still have to abide by the terms and conditions until their case is resolved.
