The man initially accused of robbing the Max’s BP convenience store in downtown Emporia better than a year ago received probation in the case.
On Wednesday, Lyon County Judge Lee Fowler sentenced Harold Stewart to 24 months probation with an underlying prison term of 29 months. The sentence is a departure from a 29-month standard prison term under consideration, but Fowler decided on probation because there was “substantial and compelling” evidence about the space between this incident and convictions dating back to the 1990s and Stewart has already served almost a year in jail.
Stewart was originally charged with robbery after the convenience store at 202 East Sixth was affected in February 2019. Stewart pleaded to attempted robbery and conspiracy to commit robbery earlier this year.
