The man accused of killing a well-known Emporian during a high-speed wreck last month has secured legal counsel.
According to Lyon County District Court Administrator Ruth Wheeler, 23-year-old Devawn Mitchell has secured Kurt P. Kerns, a Wichita-based attorney, to represent him in the case. Mitchell was scheduled for a hearing Monday that has since been postponed to next Tuesday at 1:30 pm.
Mitchell is accused of killing Steve Henry, an Emporia State Athletics Hall of Honor inductee, during a crash in the 1000 block of West Sixth on March 19. Authorities say Mitchell fled from law enforcement, even though officers had broken off a pursuit shortly before the crash.
Mitchell currently faces a single count of first-degree felony murder with an alternate count of second-degree murder. He’s also facing one count of aggravated assault on a law enforcement officer and three charges of felony flee and elude.
