The preliminary hearing for Devawn Mitchell in the crash killing Emporian Steve Henry last month is now taking place in June.
At an attorney review in Lyon County District Court on Monday, Judge Doug Jones moved the hearing from April 19 to June 2. The all-day hearing will take place inside the County Courthouse instead of online.
Jones moved the hearing at the request of Mitchell’s defense counsel, which was lined up last week and is starting the discovery process. Prosecutors believe they could have the initial evidence they need, including preliminary autopsy results, by the end of this week but did not contest the delayed hearing date.
Mitchell faces several counts in Henry’s death near Sixth and Lawrence on March 19, including first-degree felony murder with an alternate count of second-degree murder, aggravated assault on law enforcement and flee and elude.
