Trial is coming in October in the case of an Emporia man accused of killing another Emporian in a traffic crash earlier this year.
Devawn Mitchell appeared in Lyon County District Court Friday afternoon for a pretrial hearing, during which time Judge Lee Fowler set jury trial to begin on Oct. 25. Mitchell will have a final pretrial hearing on Oct. 20.
Mitchell is accused of killing Steve Henry on Mar. 18 as part of a traffic crash on West Sixth. Local law enforcement say they broke off pursuit before the wreck because of unsafe speeds and other traffic conditions.
Mitchell is accused of first-degree felony murder, aggravated assault on law enforcement and felony flee and elude. During Friday’s hearing, Mitchell pled not guilty to all counts and defense counsel Rick Meier requested that Mitchell’s bond be reduced from $1 million to $100,000.
County prosecutors objected stating the $1 million bond is sufficient as they believe Mitchell has a “high propensity to commit again.” Mitchell had just been released from jail the day before the accident back in March.
Judge Fowler denied the request for a reduced bond.
