Emporian Devawn Mitchell’s court proceedings in the traffic death of fellow Emporian Steve Henry can advance.
Mitchell was the focus of a roughly 40-minute status hearing in Lyon County District Court on Wednesday. During that hearing, Lyon County Judge Lee Fowler found Mitchell competent to stand trial. Mitchell also inquired about the possibility of a bench trial but ultimately agreed to a jury trial, which is tentatively set to begin Jan. 24 and last a week.
Mitchell is accused of killing Steve Henry on March 18 as part of a traffic crash on West Sixth between Chestnut and Lawrence after a law enforcement pursuit earlier in the afternoon.
Mitchell is accused of first-degree felony murder, aggravated assault on law enforcement and felony flee and elude.
