One of two defendants that haven’t been certified as adults in the Jesus Avila murder from September 2017 will have a hearing towards that end this week.
Samuel Garcia, age 22, has a hearing at 9 am Tuesday in Lyon County District Court. He has been charged with first-degree murder, conspiracy to commit murder, aggravated robbery. conspiracy to commit aggravated robbery, arson and other charges in the September 2017 death of Avila, who was found in a burned-out car southeast of Emporia after allegedly being shot twice in the head. Several current defendants pointed to Garcia as the person who shot Avila to death during preliminary hearings late last year.
Garcia and Alan Alanis are among six defendants charged in the case. All were juveniles at the time of the killing, and Alanis is also awaiting final word on whether he will be tried as an adult. Three others, Jordy Cornejo-Campoverde, Andrew Granado and Jovan Pecina, face first-degree murder and other charges. Armando Nunez is charged with aggravated robbery among other charges.
