A final pretrial hearing is planned Wednesday for a man accused of rape in Lyon County — and going through the court process for a second time.
Victor Cardona-Rivera faces charges of rape, aggravated criminal sodomy, aggravated battery, aggravated assault, aggravated burglary and other charges after an alleged incident in Emporia from May 2021. Court records say Cardona-Rivera was accused of raping a woman in early September 2021 after a woman in her 20s was home with her toddler and a male acquaintance got inside her home, threatened the woman and her child with a knife and subsequently raped the woman.
Trial in April led to a not-guilty verdict on one aggravated battery charge, but the jury could not reach a verdict on the other eight counts.
The pretrial is at 4 pm Wednesday in front of Judge Lee Fowler. Trial is tentatively set to begin Monday and could last all next week.
