Court proceedings will continue in October for an Emporia man accused of attempted second-degree murder and other counts related to an alleged shooting and home invasion robbery from October 2020.
According to court documents made available to KVOE, Marcos Diaz waived his right to a speedy trial during a status conference in front of Judge Lee Fowler in Lyon County District Court Monday. Diaz will next appear for a pretrial hearing on Tuesday, Oct. 18.
A second pretrial hearing was also set for 3 pm on Friday, Oct. 28.
Diaz has been charged with attempted second-degree murder, intentional, with an alternate count of aggravated battery. He’s also charged with single counts of aggravated robbery, conspiracy to commit aggravated robbery, aggravated child endangerment, contributing to a child’s misconduct and criminal discharge of a weapon. One of the three aggravated burglary counts has been dismissed.
Charges against Diaz followed an alleged shooting of one person near Linn and Whildin and a robbery at 9 South Rural in October 2020. Two other defendants have already been sentenced for their involvement. Lance Sutton was sentenced to over 20 years in prison, while Kenneth Hopkins received 29 months.
