Court proceedings continue for one person initially accused of a home invasion robbery this past May, but the lead charges have been dropped — and cases against four of the five co-defendants have been dismissed, at least for now.
On Monday, Christopher Diaz had several counts dismissed, including the lead charges of aggravated robbery, aggravated burglary, aggravated battery and aggravated assault due to “inability to obtain victim’s service.” Diaz remains charged with two counts of drug possession, one count of marijuana distribution and one count of paraphernalia possession.
Diaz has a pretrial hearing at 2 pm Sept. 30. Bond is at $100,000.
Meanwhile, cases against Lucas Aleman-Torres, Raul Diaz III and Alfredo Perez Jr were dismissed Tuesday after failure to “obtain service” from the alleged victim. They had been charged with aggravated robbery, aggravated battery, aggravated assault and aggravated burglary. Amber Spencer’s case involving charges of aggravated robbery, aggravated battery and conspiracy to commit aggravated battery was also dismissed Tuesday.
Cases against these four defendants were dismissed without prejudice, so charges can be refiled.
The case against Jonathon Manzano was dismissed back in May and were then refiled. Besides the core charges, he has been charged with drug and paraphernalia possession.
The case came to light in early May after people were running in the area of an unlisted apartment building in northeast Emporia and one person was screaming for help. Officers said several suspects armed with guns and at least one knife got into an apartment before beating and burning the alleged victim. Arrests of the six defendants followed through mid-May.
