A man accused of attempted murder and other charges in a pair of incidents in Emporia three years ago will have a hearing in Lyon County District Court this week.
Marcos Diaz is in court Wednesday for a pretrial conference.
One of the nine counts initially lodged against Diaz in an alleged shooting and home invasion robbery in late October 2020, aggravated burglary, has been dismissed. However, Diaz is still charged with attempted murder, aggravated burglary, aggravated robbery, conspiracy to commit aggravated robbery, attempted aggravated robbery, aggravated child endangerment, contributing to a child’s misconduct and criminal discharge of a firearm.
The hearing is at 9:30 am.
Charges against Diaz followed an alleged shooting of one person near Linn and Whildin and a robbery at 9 South Rural. Two other defendants have already been sentenced for their involvement. Lance Sutton was sentenced to over 20 years in prison, while Kenneth Hopkins received 29 months.
