One of three defendants in allegedly separate but linked shooting and home invasion robbery incidents from late October 2020 has a hearing in Lyon County District Court on Wednesday for allegedly connected violent criminal activity from the same time period.
Lance Paige Sutton is in court Wednesday for attempted second-degree murder, with an alternate count of aggravated battery. Sutton also faces single counts of conspiracy to commit aggravated robbery, attempted aggravated robbery and criminal discharge of a firearm. Sutton is accused of trying to kill Michael A Wilson either Oct. 27 or Oct. 28, 2020. He’s also accused of conspiring with Marcos Diaz, an unnamed juvenile and a currently unidentified suspect for the purpose of robbing Wilson of marijuana and money.
The motions hearing is at 3 pm before Judge Jeff Larson. A status hearing is tentatively set for Feb. 1, with trial possibly starting as soon as Feb. 6.
Sutton, Kenneth Hopkins and Diaz were ultimately arrested after one person was shot near Linn and Whildin and the robbery occurred at 9 South Rural — allegedly on Oct. 28, 2020. In August 2021, Sutton was sentenced to just over 17 years in prison for aggravated robbery with a dangerous weapon, as well as over three years for one count of aggravated burglary. Sutton appealed to the Kansas Court of Appeals but the panel affirmed his convictions. KVOE News has been told that decision is now under appeal.
Hopkins was sentenced to 29 months, while Diaz is still working through the court process in the case filed in 2020. Diaz has not been charged in connection to the case filed last year, according to the Kansas District Court Public Access Portal.
