Samuel Garcia was initially set for an arraignment hearing next week as his first-degree murder case continues in Lyon County District Court. Garcia now has a different hearing on the docket, and it’s earlier in the week than first planned.
Instead of being in court Thursday, Garcia has a plea hearing at 9:30 am Monday before Judge Jeff Larson.
Garcia now faces six counts in the 2017 death of Jesus Avila, including first-degree murder, aggravated robbery, conspiracy on both those charges, theft, arson and interference with law enforcement. He originally faced 11 counts before prosecutors amended the legal complaint back in October. Several co-defendants have said Garcia was the gunman in Avila’s death.
One of Garcia’s co-defendants, Armando Nunez, is in the middle of a 47-month sentence after pleading no contest last year to attempted burglary of a vehicle with intent to steal a firearm, interference with law enforcement and criminal damage.
Four co-defendants are awaiting hearings in their respective cases. Andrew Granado and Jovan Pecina have status hearings May 24. Jordy Cornejo-Campoverde has a status hearing June 1. Alan Alanis has a review hearing July 13.
