Sentencing is ahead next month after a defendant in a Lyon County attempted murder case accepted a plea agreement Thursday.
On Thursday, Marcos Diaz pleaded no contest to two counts of conspiracy to commit robbery and one count of attempted aggravated battery. Prior charges, including attempted second-degree murder, aggravated robbery, attempted aggravated robbery, aggravated burglary, aggravated child endangerment, contributing to a child’s misconduct and criminal discharge of a firearm at an occupied vehicle were dismissed.
Sentencing is Sept. 28. Diaz could receive over five years in prison, based on the decision from Judge Lee Fowler.
Diaz was charged, along with Lance Sutton and Kenneth Hopkins, after a shooting at Linn and Whildin and a home invasion robbery in the 10 block of South Rural in October 2020. Sutton has been sentenced to over 20 years in prison, while Hopkins got 29 months.
Sutton is awaiting sentencing in a connected case after pleading guilty last month to single counts of conspiracy to commit robbery and attempted aggravated battery. Neither Diaz nor Hopkins were charged in that case.
