Potential trial dates in a Lyon County rape case have been delayed.
On Wednesday, Judge Laura Miser pushed possible trial dates for Timothy Ray Davis from August to October or November, depending on a motions hearing Oct. 13 and a status hearing Oct. 18. As it currently stands, trial could start Oct. 23, Nov. 13 or Nov. 20. Prosecutors asked for the continuance because the alleged victim will not be available for the previously-set trial proceedings later this month or next month.
Davis is charged with one count of rape and one of aggravated sexual battery, both involving an alleged victim who was incapable of giving consent due to alcohol or drugs as part of an alleged incident in early January. The rape count has an alternate count of aggravated sexual battery.
Separately, pretrial and arraignment proceedings are ahead in a Lyon County drug distribution case.
Carl David Colyer will appear in court Sept. 15.
At a preliminary hearing Wednesday, Judge Lee Fowler dismissed a count of attempted unlawful acts involving proceeds derived from a drug transaction, citing a lack of probable cause.
Colyer remains charged with possessing up to 100 grams of methamphetamine with intent to distribute, although the crime severity level was dropped from Level 2 to Level 3 due to the weight of drug as tested. Colyer is also charged with possessing drug paraphernalia.
