A Lyon County criminal case originally listed as for attempted murder and other charges will go to sentencing on attempted manslaughter Tuesday.
Rafael Castaneda pleaded no contest in July to attempted voluntary manslaughter, aggravated burglary, criminal discharge of a weapon and criminal damage. The attempted manslaughter count was an alternate to the attempted murder charge, which was dropped as part of the plea agreement.
Castaneda has been accused of trying to kill Orlando Cortez during a reported shots fired incident in the 10 block of Market in early February.
Sentencing is at 9:30 am before Judge Jeff Larson.
Separately, sentencing is coming Tuesday afternoon for Arlo Feuillerat, the Emporia High student who allegedly brought a BB gun to the high school in late March and then ran out of the building, prompting lockdowns at the high school, Emporia Middle School, Flint Hills Technical College, USD 253 Transitions at the college and Village Elementary. Feuillerat accepted a plea agreement involving a count of misdemeanor assault last month, meaning a charge of aggravated assault was dropped.
Sentencing is at 2 pm.
Also, a Lyon County man accused of violent sexual activity has a motions hearing Tuesday afternoon.
Gerald Travis Todd will appear before Judge Lee Fowler at 3 pm, in part to discuss a prosecutor motion to add another witness following a defense motion to allow an expert witness time for case review.
Todd is accused of two counts of rape and four counts of aggravated criminal sodomy, all involving an alleged victim incapable of giving consent. Trial is tentatively set for Oct. 16-20, with a status hearing Oct. 11.
