One of three Emporia men initially accused of involvement in a shooting and home-invasion robbery nearly three years ago will spend time in prison for the crime.
Marcos Diaz had pleaded no contest to two counts of conspiracy to commit robbery, as well as one count of attempted aggravated battery, back in August. Judge Lee Fowler sentenced Diaz to 41 months in prison for attempted aggravated battery, with 13 months each for the conspiracy counts. He will also have 24 months of postrelease supervision.
Prior charges, including attempted second-degree murder, aggravated robbery, attempted aggravated robbery, aggravated burglary, aggravated child endangerment, contributing to a child’s misconduct and criminal discharge of a firearm at an occupied vehicle were dismissed.
Diaz was charged, along with Lance Sutton and Kenneth Hopkins, after a shooting at Linn and Whildin and a home invasion robbery in the 10 block of South Rural in October 2020. Sutton has been sentenced to over 20 years in prison, while Hopkins got 29 months.
