Extradition processes will continue for Phillip Lieurance following a hearing in Lyon County District Court Tuesday afternoon.
At the start of the hearing, Lieurance’s attorney Rick Meier had stated his client was in favor of waiving extradition, meaning he would consent to be voluntarily transfered back to Colorado to face charges there. However; Lieurance was appearing via Zoom and an individual must execute a written waiver in person before the court in order to do so.
Following a brief recess, Lierance was brought before Judge Doug Jones at which time Meier stated Lieurance would not be waiving extradition as originally planned. Judge Jones then set Lieurance’s next extradition hearing for December 5 at 1:30 pm.
Prosecution noted during the hearing that the 90-day timeframe for which extradition must occur will not begin until all of Lieurance’s cases in Lyon County District Court are resolved. Lieurance is currently being held in several cases including charges of aggravated battery and other charges after he was arrested following an incident on the Kansas Turnpike on September 11.
His arrest in Lyon County came shortly after fellow Emporians Linda Estrada and Amy Ford were reported as missing with both later being found dead near Eads, Colorado on September 20. The extradition counts accuse Lierance of unlawfully leaving Colorado after the reported murders of Estrada and Ford and indicate charges of Class 2 murder and tampering with a deceased human body, although court officials in Kiowa County, Colorado, have said formal charges have not been filed and will not be activated until Lieurance makes an official appearance before a Colorado judge.
