An appeal is coming after an aggravated battery conviction in Lyon County District Court from this past fall.
Logan Casteel was sentenced earlier this month to 52 months in prison. The jury found Casteel guilty of both aggravated battery and attempted voluntary manslaughter following a three-day trial in October, but Judge Lee Fowler dismissed the attempted manslaughter count after the verdict was announced.
Defense attorney Rick Meier’s appeal is based on alleged pretrial and trial errors as well as an erroneous conviction. The Kansas Appellate Defender’s Office will represent Casteel during the appeal.
Casteel was convicted after shooting Justin Smith during an incident just southwest of Emporia in October 2022. He was initially charged with attempted murder in the case.
