A motions hearing is coming next month in a Lyon County drug distribution case.
Michael D Bishop is charged with single counts of possession with intent to distribute up to 100 grams of methamphetamine, possession of marijuana, possession of Adderall and possession of drug paraphernalia. Charges followed an alleged incident this past October.
The hearing, tentatively set for March 22 after a hearing in Lyon County District Court last week, stems from a defense motion to suppress evidence from a search and seizure in October. Defense attorney Steve Atherton says the resulting seizure was done without a valid search warrant, without knowing and voluntary consent, without reasonable grounds to believe the defendant was armed and dangerous and was not supported by probable cause or reasonable suspicion.
As it stands, the Bishop case is set for trial to begin either April 22, April 29 or May 13. A trial status hearing is on the docket April 17.
