The trial schedule is changing for an Emporia rape case.
Dominik Simunovic was originally set for trial to begin May 13, but prosecutors requested trial to begin April 29 so attorneys could attend an out-of-state conference. Judge Jeff Larson agreed as part of a motions hearing Wednesday. Trial is tentatively set to last three days, with a motions hearing March 14 and a trial status hearing April 24.
The former Emporia State tennis player is facing single counts of rape and aggravated criminal sodomy after an alleged incident this past October. Both counts have alternates alleging the victim was incapable of giving consent due to the presence of alcohol, drugs or other substances.
