With jury instructions issued, it appears highly likely an Emporia rape case will go to trial next week.
Judge Lee Fowler finalized the jury instructions as part of a status hearing Wednesday in the case against Gerald Travis Todd. If there is no late plea or delay, trial is to begin Monday and could last through March 28.
Todd has been charged with two counts of rape and four of aggravated criminal sodomy after an alleged incident in August 2021. The legal complaint accuses Todd of illegal activity with somebody incapable of giving consent due to alcohol or drugs.
Trial has already been delayed at least once in this case
