Court processes continue to move towards a trial date in the case of a former Emporia State tennis player accused of rape.
Trial is set to begin April 29 for Dominik Simunovic. On Friday, Judge Jeff Larson approved a state motion to endorse more witnesses for trial after getting no objection from defense attorney Rick Meier. On the topic of laboratory testimony from the Kansas Bureau of Investigation, Meier agreed to information through an alternate witness involved in the process.
Simunovic faces single counts of rape and aggravated criminal sodomy after an alleged incident in downtown Emporia this past October. Both counts have alternates alleging the victim was incapable of giving consent due to the presence of alcohol, drugs or other substances. Simunovic says activity was consensual.
Trial could last through May 1. A trial status hearing will take place April 24.
