A motions hearing this week could lead to trial in the case of an Emporia man accused of child rape in Sedgwick County.
The motions hearing is at 1:30 pm Friday in the case against John Robert Burton. His defense team has asked for a motion in limine, a standard motion to quash certain statements at different points of trial. Prosecutors, meanwhile, have asked for a Jackson vs Denno hearing, which takes place outside a jury’s presence to determine whether a confession was voluntary and can be used during a trial.
Trial could follow as soon as Monday morning in Sedgwick County District Court.
The Kansas District Court Public Access Portal lists Burton as charged with single counts of rape and aggravated indecent liberties, both involving an alleged victim under the age of 14.
