A Lyon County case involving charges of child sex abuse, kidnapping, burglary, robbery and other counts is still tentatively set for a September trial after a motion hearing last week, although developments Friday may well delay the remaining court proceedings.
Daniel Olivarez remains accused of holding several people inside an Emporia home at gunpoint, having one of the alleged victims drive him to another location and then forcing a better than three-hour standoff before surrendering to local authorities as part of a lengthy incident in Emporia this past January. He’s formally charged with aggravated indecent liberties, aggravated kidnapping, kidnapping, aggravated robbery, aggravated residential burglary, aggravated battery and aggravated assault among other charges.
On Thursday, defense attorney Brian Henderson filed a motion to withdraw, saying the attorney-client relationship “has been deteriorating.” During Friday’s hearing, prosecutors asked for a prime jury setting, meaning one start date instead of several options. They also filed a motion for “child-friendly” trial procedures, including occasional recesses, any objections during child testimony to be made in a “non-threatening” manner and unspecified seating modifications.
A status hearing is tentatively set for Aug. 15, with a trial status hearing slated for Sept. 4. Trial is set to begin Sept. 9.
