Motions are set to be discussed at the next hearing for an Emporia man accused in Lyon County District Court of child rape.
Erik Alvarez had a pretrial hearing Friday. During that hearing, Judge Laura Miser fielded a state request for a prime trial setting — meaning a firm start date for trial with a backup as opposed to two or three possible start dates. Trial is tentatively set to begin Jan. 27, 2025, with Feb. 3 as the backup start date. The trial status hearing will be Dec. 19, with a final pretrial Jan. 22. A motion hearing is set for Nov. 1.
Judge Miser also approved a state motion requesting reciprocal discovery.
Alvarez faces one count of rape after alleged illegal sexual activity with a child under the age of 18 in January 2021. Court records indicate the alleged victim was no more than 14 years old at the reported incident.
