A man who pleaded no contest to drug distribution in a Lyon County criminal case will spend nearly eight years in prison.
Rafael Munoz Garcia, age 27 of Topeka, received a 95-month total sentence as part of a hearing this week. Judge Laura Miser issued the sentence after Garcia had pleaded no contest to two counts of distributing small amounts of methamphetamine during a hearing in late March where other charges, including using a cell phone to commit a felony drug violation, drug possession, interference with law enforcement and aggravated child endangerment, were dropped.
Sentences will run consecutively, or back-to-back. A notice of appeal has been filed, involving the sentence, a previous denial of a defense motion of departure for the sentence and all “adverse rulings and decisions” made during the case.
