Lyon County Judge Jeff Larson has set a pretrial hearing date as a fraud case continues against a former manager of Emporia’s Four Seasons Apartments.
Apartment management filed a lawsuit against former manager Alisha Hammond just under a year ago, alleging Hammond stole around $84,000 while she managed the complex. Current management also says it was “compelled to file this action” after Lyon County prosecutors declined to press charges.
A motion hearing was tentatively set for Wednesday, but attorneys for Four Seasons were unavailable. Hammond’s defense team has filed motions for summary judgment and for sanctions after the plaintiff allegedly filed claims barred by the statute of limitations. Four Seasons attorneys, meanwhile, say Hammond has “conveniently ignored” other statute of limitations matters that apply to this case — also saying Hammond was “absolutely an employee at law” at Four Seasons even though she did not sign an employment contract specifically with Four Seasons.
The next hearing in this case is now set for Oct. 1. Four Seasons LLC is requesting damages — costs, attorney fees and other unspecified relief — in excess of $75,000 against Hammond.
