Attorneys on both sides of the latest appeal filed by Scott Cheever now have a week to file motions in the case.
In late September, Judge Mike Ward approved an extension from Sept. 30 to Nov. 14, giving attorneys six weeks to file what are called findings of fact, conclusions of law and evidentiary proffer — splitting the difference in the 90-day request for more time from defense attorney Brianna Harris and the 30-day request from the Kansas Attorney General’s Office.
Cheever shot Greenwood County Sheriff Matt Samuels to death in early 2005 as Samuels was leading a drug raid near Hilltop. Cheever was convicted of capital murder in 2007 and was sentenced to death — along with over 700 months in prison for charges including attempted capital murder, manufacturing methamphetamine and conspiracy to manufacture meth.
Cheever has been through a number of unsuccessful appeals since his conviction. The current appeal is focused on claims of ineffective counsel.
